Petitioner is seeking regular bail in connection with Ishipur (Barahat) P.S. Case No. 09 of 2017, registered for the offence alleged under Sections 461 and 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that two mobile of Lava Company which are said to be the stolen mobiles from the shop of the informant were recovered from the shop of this petitioner. Learned counsel further submits that this petitioner is himself running an electronic shop and the petitioner had purchased both the mobiles in good faith from his co-villager Md. Chhotu and his
Patna High Court Cr.Misc. No.32701 of 2017 (2) dt.20-07-2017 2/2 younger brother Rouki. Hence, he is a bona fide purchaser of the mobiles. Learned counsel further submits that in course of investigation also it has come that the petitioner had purchased both the mobiles from the co-villagers. The petitioner is said to be in custody since 30.04.2017 and has no criminal antecedent as stated in paragraph-3 of the application.
In the facts and circumstances, let the petitioner, namely, Md. Aurangjeb be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIII, Bhagalpur, in connection with Ishipur (Barahat) P.S. Case No. 09 of 2017, subject to the conditions U/s 437(3) Cr.P.C.
