The petitioner wants to renew the prayer of bail which was earlier twice rejected vide order dated 20.09.2016 and 21.06.2017 passed in Cr. Misc. No. 31933 of 2016 and Cr. Misc. No. 16238 of 2017 respectively, on the ground that the petitioner is suffering in custody since 04.03.2016, there is general and omnibus allegation, trial is going on, only four prosecution witnesses have been examined. Other co-accused are on bail and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes the prayer of bail by submitting that the petitioner is the assailant.

No.3342 of 2018(2) dt.24-01-2018 2/2 In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected in connection with Sessions Trail No. 315 of 2016 (arising out of Marhaura P.S. Case No. 517 of 2015) pending in the court of learned A.D.J.-II, Saran at Chapra.

However, considering the detention of the petitioner, let the trial be expedited and concluded as early as possible preferably within four months, from date of receipt/production of a copy of this order.
