Petitioners apprehend their arrest in C-III-3 of 2009 registered under Section 47 (a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioners submits that the petitioners have committed no offence and have falsely been implicated in this case. It is further submitted that the recovery of alleged country made liquor and spirit has been made from the bathan, which is an open place.

Having considered the above facts and circumstances of the case, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a
