JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 363/365 of the Indian Penal Code.

The basic accusation is of kidnapping wife of the informant by Nazir Mian who took along with her gold and silver ornaments worth Rs. 50,000/-, Rs. 10,000/- cash and five year old daughter of the informant. It is alleged that petitioners were also part of the whole conspiracy.

It is submitted by the learned counsel for the petitioners that petitioners are simply roped in this case as they are brothers of Nazir Mian. Statement has been in paragraph 3 of the petition that the petitioners have no criminal antecedent.

No.14128 of 2016 (2) dt.31-03-2016 2/2 Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail till the conclusion of investigation in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Paharpur P.S. Case No. 276 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
