JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 06-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Sarairanjan P.S. Case No. 299 of 2016 registered for the offences punishable under Sections 328 and 304-B/34 of the Indian Penal Code.
Regard being had to the gravity of the offence and the serious nature of allegation made in the FIR, I am not inclined to grant pre-arrest bail to the petitioner nos.1 and 2,
Patna High Court Cr.Misc. No.21223 of 2017 (2) dt.06-07-2017 2 / 2 namely, Sanjay Sahni and Rampulis Sahni. Accordingly, their application for grant of pre-arrest bail is rejected. So far as petitioner nos. 3 and 4, namely, Sumitra Devi and Sushila Devi are concerned, they, being sister-in-law and mother-in-law of the deceased and there being no specific allegation against them, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Samastipur in connection with Sarairanjan P.S. Case No. 299 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of their arrest or surrender within a period of six weeks from today.
