The petitioner seeks bail in connection with Sessions Trial Case No.209 of 2018 arising out of Kishanganj P.S. Case No.8 of 2017 registered under Sections 302, 341, 323 and 120B read with 34 of the Indian Penal Code. Considering that the direct and specific allegation of assaulting the father of the informant Abid Ali with a piece of wood is confined against one Md. Hasan as a result of which he died and co-accused Sairazul Haque whose case is identical to that of the petitioner has already been granted bail vide order dated 20.02.2018 passed in Cr. Misc. No.9143 of 2018 by a Bench of this Court, the petitioner, who is in custody since 04.12.2018, is directed to be released on bail on furnishing bail
Patna High Court CR. MISC. No.16422 of 2019(3) dt.21-05-2019 2/2 bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Kishanganj in connection with S.T. No.209 of 2018 arising out of Kishanganj P.S. Case No.8 of 2017, subject to the following conditions:- (a) that the petitioner shall attend court in accordance with the conditions of the bond executed;
(b) that the petitioner shall not commit an offence similar to the offence of the present case; and (c) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
