JUSTICE ARUN KUMAR ORAL ORDER 11-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 22.1.2018, seeks bail in Manjhauliya PS Case No. 105 of 2017 registered under Sections 366A/34 of the IPC.

The allegation in brief is that minor daughter of the informant was enticed away by the petitioner along with others. Learned Counsel for the petitioner submits that the FIR was lodged after much considerable delay, the girl was not recovered from the possession of the petitioner rather she turned up on her own, her statement was recorded according to which she is said to have identified the petitioner by voice and there is no specific assertion that this petitioner was identified physically by the girl. Having considered the said facts and circumstances, the petitioner, namely, Raj Kumar Sah is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bettiah, West Champaran in connection with Majhauliya PS Case No. 105 of 2017.
