2. This is the second attempt of the petitioner for grant of regular bail as earlier the bail application of the petitioner was rejected vide order dated 09.11.2023 passed in Cr. Misc. No. 72689 of 2023.

3. The petitioner seeks bail in connection with Gaya Muffasil P.S. Case No. 20 of 2022 registered for the offence under Sections 307/34 of the Indian Penal Code and under Section 27 of the Arms Act.

4. As per the prosecution case, the petitioner is said to have fired upon the informant.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he is in custody

Patna High Court CR. MISC. No.19245 of 2024(4) dt.09-08-2024 2/2 since 19.7.2023. He also submits that the firing did not hit anybody.

6. Considering the aforesaid facts and the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Gaya Muffasil P.S. Case No. 20 of 2022.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Gaya Muffasil Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
