Petitioner seeks bail in a case registered for the offences punishable under Sections 376D of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offenses Act, 2012.
The victim has not levelled any allegation against the petitioner in her statement under Section 164 Cr.P.C., rather the allegation of commission of rape is against other person. Considering the statement of the victim, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mahila Police
Patna High Court Cr.Misc. No.7607 of 2018 (4) dt.21-03-2018 2/2 Station Case No. 33 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
