Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 447, 341, 323, 326, 307 and 34 of the Indian Penal Code and 27 of the Arms Act.
Allegation against the petitioner is of firing due to which, sustained injury on the thigh of the informant. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. It is further submitted that the petitioner has been implicated in this case due to enmity. No.13910 of 2022(2) dt.18-08-2022 2/2 chased by the wife of the petitioner namely Shanti Devi through registered sale deed in 2021 and other accused persons Subhash and Prakash Yadav were trying to disposses the petitioner from the said land by using fire arms which hit the informant. It is submitted that charge-sheet has been submitted and has no criminal antecedent. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.
Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. case No. 121 of 2021.
