2. This is the first regular bail application of the petitioner seeking his regular bail in connection with S.T. No.516 of 2024 arising out of Laxmipur P.S. Case No.240 of 2024 registered for the offence under Sections 103(1), 61 and 3(5) of BNS.
3. In this case, there are six named accused persons along with petitioner herein. According to the case of prosecution, on 17.07.2024 at about 07:00 P.M. the present applicant along with other accused persons taken the deceased Sanoj Tanti with them and subsequently, on the next day, the
Patna High Court CR. MISC. No.14579 of 2025(3) dt.12-05-2025 2/3 dead body of the deceased Sanoj Tanti was found near Sindhiya river. On the basis of information given by the father of the deceased, offence has been registered and during course of investigation, on the basis of statement made by co-accused Mithilesh Kumar Tanti, the present applicant has been arrested.

It is submitted by the learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in the present case due to previous dispute with the deceased and his family members. Further, he submits that there is no any legal evidence available on record on the basis of which it can be said that the present applicant is involved in the alleged crime in question. Apart from the confessional statement made by co-accused Mithilesh Kumar Tanti, there is no evidence available on record against the present applicant. Further he submits that though as per the information given by the informant, some of the persons were seen the present applicant and other co-accused persons along with the deceased but the statement of those persons were not recorded by the prosecution. Therefore, there is no any legal evidence available on record against the petitioner. Petitioner is in custody since 06.10.2024 and charge sheet has been filed and the trial will take more time, therefore, on these grounds, it is prayed that the
Patna High Court CR. MISC. No.14579 of 2025(3) dt.12-05-2025 3/3 petitioner may be granted benefit of bail.
5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

7. Perused the case diary and other materials available on record.
8. Considering the submissions made by the counsel for the petitioner and particularly considering the fact that apart from the confessional statement of co-accused, no any other evidence is available against the present applicant, I am of the view that it is a case where the petitioner should be granted benefit of bail.
9. Accordingly, the application is allowed.
10. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Jamui, in connection with S.T. No.516 of 2024 arising out of Laxmipur P.S. Case No.240 of 2024.
