The petitioners herein are farmers attached to the respondent no.8, the Sanokhar Primary Agriculture Credit Cooperative Society in the district of Bhagalpur and complain of non-payment of price for the paddy supplied by them to the society as is manifest from their statement made in paragraph 8 of the writ petition. The grievance thus is directed against the society concerned and which is not amenable to the writ jurisdiction of this Court.
In the circumstances and for the present, I would direct the petitioners to raise their grievance under section 48 of the Bihar Cooperative Societies Act, 1935 before the Registrar, Cooperative Societies and who shall consider the grievance of the petitioners either by himself or transfer the matter to any other appropriate authority duly notified to discharge such duty
Patna High Court CWJC No.6820 of 2016 (2) dt.04-07-2016 for disposal in accordance with law after hearing the contesting parties. Since the matter relates to payment of farmers for the Kharif Marketing Season 2014-15 hence expeditious disposal within three months from date of filing of such claim would be expected.
