Mr. SRI ARUN KUMAR SINGH -5 ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Birpur P.S. Case no. 162 of 2017 registered for the offences punishable under Sections 302, 201, 120B and 379 of the Indian Penal Code.

Allegation against petitioner is that he was also involved in conspiracy with other accused persons in killing son of informant.

It is submitted on behalf of the petitioner that he is not named in the FIR and he is innocent and has falsely been implicated in the case. Only allegation which has come during investigation is that there is suspicion against petitioner in killing of son of informant. Except that there is nothing against petitioner. Petitioner has no criminal antecedent and he is in

Patna High Court Cr.Misc. No.5893 of 2018(3) dt.27-02-2018 2/2 custody since 16.7.2017. It is further stated that FIR named accused Motiur Rahman against whom specific allegation of killing of son of informant is alleged has been granted bail by a Bench of this Court in Cr. Misc. no. 61618 of 2017 dated 8.2.2018.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM, Birpur (Supaul) in connection with Birpur P. S. Case no. 162 of 2017. (S. Kumar, J) sudip/- U T
