JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 307, 385, 435, 354 and 504 of the Indian Penal Code and under Section 27 of the Arms Act.

The prosecution case is that the petitioners along with other co-accused persons variously armed came at the house of the informant. Co-accused Ramdeo Yadav opened fire and demanded Rs. 5 lacs. Further petitioner no. 1 Sudish Yadav pulled sari of Rina Devi. Co-accused Arun Yadav misbehaved with Bindu Devi. Petitioner no. 2 Khalath Yadav @ Dashrath Yadav assaulted the informant by butt of rifle on his left hand.

It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.12737 of 2016 (2) dt.28-03-2016 2/2 that prior to lodging of present FIR wife of petitioner no. 1 lodged Khagaria (Muffasil) P.S. Case No. 213 of 2015 earlier in point of time. It is further submitted that injuries of the informant are simple in nature, but opinion is reserved.

Considering the facts and circumstances, let the petitioners above named be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 258 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
