The petitioner is in custody in connection with Makhdumpur P.S. Case No.106 of 2017, a case under Section 304B/34 of the Indian Penal Code, pending in the Court of Chief Judicial Magistrate, Jehanabad.
Petitioner is husband of the victim of dowry death. There is allegation of demand of dowry and torture for the same soon before death. The victim died within three years of marriage in her matrimonial house in unnatural circumstances. The matrimonial family members of the deceased have supported the allegation of demand of dowry and torture before the police whereas the co-villagers of the petitioner have stated before the
Patna High Court Cr.Misc. No.5114 of 2018 (4) dt.16-03-2018 P2/ police that in fact the victim was ill and only wrong which the petitioner and other family members committed that they went to earn their livelihood leaving the ill victim. Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail for the present. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial and conclude the same within nine months, failing which the petitioner would be at liberty to renew the prayer for bail before the learned trial judge itself, who shall pass a reasoned order.
