JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-05-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 387/379/34 and other allied sections of the Indian Penal Code.
As per the prosecution case, petitioner and two other accused persons, named in the FIR, are alleged to have assaulted the informant.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Doctor has found simple injuries. Petitioner claims clean antecedent.
Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender
Patna High Court CR. MISC. No.15509 of 2023(2) dt.18-05-2023 2/2 within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Madhuban Police Station Case No. 255/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
