The petitioners are seeking anticipatory bail in connection with Mansahi P.S. Case No. 126/2018 registered under Sections 147, 341, 323, 325, 307, 354, 379 & 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are own gotias of the informant. It is stated that there is a dispute over the Jal kar and in course of that dispute a free fight seems to have taken place in which both sides have assaulted each other. Learned counsel for the petitioners submits that both sides have suffered injuries which are simple in nature.

Patna High Court CR. MISC. No.13230 of 2019(2) dt.08-03-2019 2/2 It is further submitted that there are two different stories of the alleged occurrence. These petitioners are having no criminal antecedent.

Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail of the petitioners. Considering the fact that there is a case and counter case as also both sides have suffered injuries and the dispute is said to be over a jal kar which has given rise to the present case, in the event of their arrest/surrender before the court below within a period of four weeks, let the above-named petitioners be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Mansahi P.S. Case No. 126/2018, subject to condition that petitioners will join investigation by reporting to the Investigating Officer within a period of two weeks from today and will cooperate in course of investigation.
