JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2017 The petitioner seeks regular bail in connection with East Colony P.S. Case No. 57 of 2016, registered for offences punishable under Section 379 of the Indian Penal Code. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R, his name has surfaced in this case only on the basis of confessional statement of co-accused and except that there is nothing against him. Further so far criminal antecedent is concerned; he has been made accused in all those cases on the basis of confessional statement. Further he has been in judicial custody since 06.04.2017.

Learned counsel for the State opposed the prayer for bail and submitted that he is accused in four other cases of similar nature as such he does not deserve the privilege of bail.

Patna High Court Cr.Misc. No.31441 of 2017 (2) dt.13-07-2017 2/2 Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly rejected.

However, the trial court is directed to expedite the trial and try to conclude it within a period of six months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the court below itself. (Vinod Kumar Sinha, J) sunil/- U
