Petitioner, already in custody, seeks bail in connection with Jhajha P.S. Case No.246 of 2017, registered under Sections 121, 121(A) and 120B of the Indian Penal Code, under Sections 16, 17, 18, 19, 20, 21 and 22 of the U.A.P. Act as well as under Sections 3⁄4 of the Explosive Substance Act.

Learned counsel for the petitioner submits that the petitioner was neither apprehended at the spot nor any incriminating article was recovered from his possession, however except disclosure of his name by another co-accused, there is no other material against the petitioner. It is further submitted that the petitioner has no criminal antecedent and two other co-accused Bisheshwar Modi and Ranjeet Modi have been

Patna High Court Cr.Misc. No.11809 of 2018(3) dt.09-04-2018 2/2 admitted to bail by this Court vide Cr. Misc. No.7902 of 2018 on 08.02.2018.

Having considered the aforesaid facts and circumstances, petitioner Dilchand Ray is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thouand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Jhajha P.S. Case No.246 of 2017.
