The appellant is apprehending his arrest in connection with Bhagwanpur P.S.Case no.154 of 2018 dated 4.9.2018 , registered for offences punishable under Sections 341, 323, 324, 307, 504,506, 385, 353, 279/34 of the Indian Penal Code and Section 3(1)(r)(s) of SC/ST (Prevention of Atrocities) Act. Allegation against the appellant is that he dashed his motorcycle to the motorcycle of the informant; due to which he received injuries, abused him and asked as to why he has lodged a case against him and demanded Rs.50,000/- . Submission of the learned counsel for the appellant is that as a matter of fact the wife of the appellant is Secretary to the School Committee, in which the informant is the Headmaster and she had made complaints against the informant for misappropriation of funds and due to that the present case has been lodged and the falsity of the case will appear from the fact that on 1.9.2018 the police arrived and took him to the Hospital but in spite of that a case has been lodged on 04.09.2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the appellant, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Addl. Sessions Judge-cum-Spl. Judge, SC/ST, Vaishali in connection with Bhagwanpur P.S.Case No.154 of 2018 dated 04.09.2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this appeal is allowed and the impugned order is set aside.
