Although this matter has been listed under the heading 'To be mentioned' but considering the nature of relief prayed for in this writ petition the matter has been taken up for final disposal at this stage itself with the consent of the parties. The limited relief prayed for by the petitioner who happens to be the licence holder under the Public Distribution System Control Order (hereinafter referred to as 'the Control Order') is for a direction to the appellate authority under 'the Control Order' i.e. the District Magistrate, Saran at Chapra to dispose of the appeal bearing Supply Appeal No.33 of 2013 filed by the petitioner questioning the order dated 11.5.2013 passed by the Licensing Authority -cum- Sub-Divisional Officer,

Patna High Court CWJC No.6706 of 2015 (2) dt.26-06-2015 Marhowrah, district- Saran whereunder the licence granted to him for operating the fair price shop bearing Licence No.92 of 2007 has been cancelled.

Having heard learned counsel for the parties and considering the nature of relief prayed, the writ petition is disposed of with a direction to the District Magistrate, Saran at Chapra to consider and dispose of the Supply Appeal No.33 of 2013 in accordance with law and after opportunity of hearing to the petitioner expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order.
