Petitioner seeks regular bail in a case registered for the offences punishable under Sections 366(A),323,504 of the Indian Penal Code.

Though, the allegation is that the petitioner and other accused persons named in the complaint petition, of kidnapping the daughter of the informant. The statement of victim girl recorded under Section 164 Cr.P.C., would reveal allegation of rape allegedly committed by co-accused Chandrakeshwar, who is not named in the FIR and against some other unknown persons. Chandrakeshwar is maternal uncle of this petitioner. Considering the statement of the victim girl, wherein, there is no allegation leveled against this petitioner, let the petitioner,

Patna High Court Cr.Misc. No.6267 of 2018(3) dt.16-03-2018 2/2 above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Bagaha P.S. Case No. 384 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
