The petitioners seek anticipatory bail in a case instituted for the offences under Sections 147, 148, 149, 323, 354, 452, 420, 467, 468 and 504 of the Indian Penal Code.
Allegation has been made against the petitioners that they have illegally sold 3 Kathas of land belonging to the complainant/informant.
Learned counsel for the petitioners submits that from Annexure-3 it appears that Siro Mandal and Ram Prasad Mandal jointly purchased 5 Kathas of land and
Patna High Court Cr.Misc. No.18065 of 2015 (3) dt.09-07-2015 informant is grand-son of Siro Mandal whereas petitioners are grand-son of Ram Prasad Mandal and according to the document he has also half share in the said property and thereby he is also entitled two and half Kathas of land. Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Meena Devi, Prithvi Yadav, Biranchi Yadav and Rameshwar Yadav, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No.737 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal procedure.
