JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 This application, for grant of anticipatory bail, arises out of Danapur P.S. Case No. 577 of 2018, disclosing offences under Sections 498(A), 323, 341, 337, 379/34 of the Indian Penal Code.
Allegation against the petitioner is of assault to the informant and also taken away her files and jewelleries and of subjecting the informant to torture.
Submission of learned counsel for the petitioners is that she is living in the same house and all the allegations are false and concocted.
Heard learned A.P.P. as well as learned counsel for the informant. Learned counsel for the informant has submitted that she is being subjected to cruelty by the petitioner every day
Patna High Court CR. MISC. No.13650 of 2019(3) dt.30-04-2019 2/2 and further alleged that the petitioner has illicit relationship with other lady. However, she could not controvert the fact that they are living in the same building.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Danapur, Patna, in connection with Danapur P.S. Case No. 577 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is further subject to the condition that petitioner will not interfere in the life of informant and will also not subject her to cruelty, otherwise, she will be at liberty to move for cancellation of his bail bonds.
