No. 15461 of 2022 has been arrested by the police, therefore, he seeks permission to withdraw this application with regard to petitioner no. 2 in Cr. Misc. No. 15461 of 2022.

Patna High Court CR. MISC. No.15049 of 2022(2) dt.10-11-2022 2/3 Permission is granted.

Accordingly, this application is dismissed as withdrawn with regard to petitioner no. 2 in Cr. Misc. No. 15461 of 2022.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 354B, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioners are said to have assaulted the informant. It is further alleged in the FIR that co-accused Bablu Quarishi fired upon the informant which hit on her left leg. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He submits that there is case and counter case between the parties. He submits that there is no specific overt act against the petitioners. He submits that there is general and omnibus allegation levelled against the petitioners. He submits that there is specific allegation against co-accused Bablu Quarishi who fired upon the informant. He further submits that petitioners have six criminal antecedent as stated in para-3 of this

Learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Barachati P.S. Case No. 570 of 2021. (Anjani Kumar Sharan, J) devendra/- U
