The petitioner being the husband of the informant is apprehending his arrest in Dumra P.S. Case No. 104 of 2013 registered for the offences punishable under Sections 498A, 384, 386 and 504 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Sitamarhi. On the joint prayer of petitioner and the informant the matter was referred to Mediation Centre of State Legal Service Authority vide order dated 18.03.2015. The petitioner and opposite party no. 2 were directed to appear before
Patna High Court Cr.Misc. No.28656 of 2014 (7) dt.14-07-2015 2/2 the Mediator on 30.03.2015. The report of the Mediator dated 30.06.2015 at Flag 'X' reflects that the petitioner never appeared, though, opposite party no. 2 along with her counsel appeared. . It is submitted by learned counsel for the petitioner that in spite of the fact that the petitioner was intimated about the order of this Court dated 18.03.2015 but neither he participated in the mediation nor he is instructing his counsel any more.
In the circumstances, this application is dismissed.
