JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 3654(C) of 2017 in which cognizance has been taken under Section 498A IPC and Section 4 of Dowry Prohibition Act.

After appearance of opposite party No.2 the matter was referred to the Patna High Court Mediation and Conciliation Centre and the report of Mediator has been received which disclosed that dispute between the parties is likely to be resolved and for that time is sought. However, it has been admitted by both the parties that the matter has been resolved by way of one time settlement for

Patna High Court CR. MISC. No.16890 of 2019(5) dt.26-08-2019 2/2 Rs.1.5 lac. Learned counsel for opposite party No.2 admitted the same. Learned counsel for the petitioner has also handed over a Bank Draft of Rs.1.5 lac to learned counsel for the opposite party No.2, who has handed over the same to the opposite party No.2 in Court itself.

In view of above fact, let petitioner surrender in the court below by 4.9.2019 and on surrender he shall be released on bail by the court below to its own satisfaction. Since the dispute has been resolved between the parties and payment of above amount has already been made, as such it is expected that opposite party No.2, if so advised, may move for disposal of the case on the basis of settlement between the parties and both the parties are at liberty to file a petition for dissolution of marriage by mutual consent, if they so desire. With the above observation, this application is disposed of.
