JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court on merit in Cr.Misc. No. 45754 of 2017, vide order dated 17.10.2017.
Submission of learned counsel for the petitioner is that this application for grant of bail has been filed on the ground of alibi, which has been found true by the I.O. Further submission is that charge has been framed in this case.
Heard learned APP also.
Having heard both sides and in view of fact that earlier prayer for bail of the petitioner was rejected on merit. I am not inclined to grant bail to the petitioner.
However, the plea of alibi shall be considered at the time of trial and learned trial court is directed to expedite the trial and
Patna High Court Cr.Misc. No.6166 of 2018 (2) dt.08-02-2018 2/2 try to conclude it within a period of nine months, if possible, on regular basis.
