Petitioner is accused in connection with Mahua P.S. Case No. 388 of 2018 for the offence registered under Sections 302, 201, 498A, 120B/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act pending in the Court of C.J.M., Vaishali at Hajipur.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He has no concern with the alleged occurrence. Further submission is that there is general and omnibus allegation against the petitioner.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending

Patna High Court CR. MISC. No.14466 of 2020(4) dt.13-07-2020 2/2 that petitioner is the husband of the deceased. He is named in the first information report. There is direct allegation of murder of the deceased for non-fulfillment of demand of dowry. Further submission is that on perusal of Postmortem Report, it is apparent that the cause of death is due to burn injury. Hence, this is not a fit case for bail.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the State, this Court is not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for grant of regular bail is rejected.
