The petitioner is in custody in connection with Agamkuan P.S. Case No. 44 of 2017 (Special Case No. 11 of 2017) for the offence under Sections 419, 420, 467, 468, 471, 120B/34 of the Indian Penal Code, Section 66 D of the IT Act and Sections 7, 8, 9, 13(1)(c)(d) read with Section 13(2) of the Prevention of Corruption Act, 1988.

Allegation against this petitioner is that he was supplier of OMR sheets for competitive examination conducted by the Bihar Staff Selection Commission.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The petitioner is in

Patna High Court CR. MISC. No.30399 of 2019(4) dt.17-08-2019 2/2 custody since 20.03.2017 and, as such, he has remained in custody for more than two years.

Considering the period of custody and the fact that the petitioner has got no criminal antecedent and also the fact that he is the only supplier of OMR sheets, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.2,00,000/- (Rupees two lakhs) with two sureties of the like amount each to the satisfaction of Special Vigilance Judge-I, Patna in connection with Agamkuan P.S. Case No. 44 of 2017 (Special Case No. 11 of 2017) subject to the condition that the petitioner shall deposit Bank guarantee of Rs.25,00,000/- (twenty five lakhs) in the court below and the same shall abide by the final outcome in the trial with the further condition that the bailors should be the family members of the petitioner. The petitioner is also directed to deposit his pass-port in the court below and extend full co-operation in early conclusion of the trial.
