JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 This is an application for grant of anticipatory bail in connection with Koilwar P.S. Case No.232 of 2018 disclosing offences under Sections 341, 323, 504, 379, 328/34 of the Indian Penal Code.
Prosecution story as per F.I.R. is that the petitioners and other accused persons assaulted the informant and also snatched golden Mangal Sutra and forcibly putting poison in her mouth.
Submission of the learned counsel for the petitioners is that there is general and omnibus allegation against the
Patna High Court CR. MISC. No.14006 of 2019(4) dt.16-05-2019 2/2 petitioners and the occurrence took place between the children of the parties and the injury report does not support the allegation of administration of poison.
Learned counsel for the petitioners further submitted that considering the fact, this Court earlier vide order dated 06.05.2019 passed in Criminal Misc. No.10488 of 2019 had allowed the anticipatory bail to the other accused persons. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Koilwar P.S. Case No.232 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
