Case No.467 of 2013 instituted under Sections 147,148,149,341,323,307,353,452,380,354 and 427 of the Indian Penal Code.
Learned counsel for the petitioner draws the attention of the Court to the first information report in which the petitioner is not named nor there is any allegation of Doctor having been beaten up and fallen unconscious. In the second F.I.R., which is amendment to the first one, more allegations and names have been added. Then he draws the attention of the Court to the statement of the informant made under Section 164 of the Code of Criminal Procedure. It is submitted that only to cover up the negligence of the Doctor resulting in death of a patient, this
Patna High Court Cr.Misc. No.17693 of 2015 (2) dt.08-06-2015 action has been taken by the Doctor.
Be that as it may, in the facts and circumstances of the case, in the event of his arrest or surrender in the court below within a period of four weeks from today, the petitioner above named shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Kotwali P.S.
