====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 17-04-2018 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner, already in custody, seeks bail in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No. 574 of 2017, registered under Sections 302/34 and 120 (B) of the Indian Penal Code.

The allegation in brief is that the the brother of the informant (deceased) was called by one of the co-accused, Amit Kumar to the house of one Vikky Kumar where Rambabu Sah assaulted him with sharp edged weapon on the chest and lower part of the body and Abhishek Kumar assaulted on his head and this petitioner was caught hold the brother of the infrormant. Learned counsel for the petitioner submits that there

Patna High Court Cr.Misc. No.7250 of 2018(3) dt.17-04-2018 2/2 was dispute between the deceased and Amit Kumar on occasion of the procession of Mahabiri Akhara. Special allegation of assault against is Ram Babu Sah and Tripurari Kumar and there is no allegation against the petitioner of assaulting the deceased and he has no criminal antecedent except one case under the Excise Act . It is also submitted by the learned counsel appearing on behalf of the petitioner that he is in custody since 22.08.2017.

Having considered the aforesaid facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No. 574 of 2017.
