The petitioner apprehends his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
It is alleged that truck which was seized in connection with Sonepur PS Case No. 298 of 2022 and was parked in Ramana Maidan was taken away by this petitioner. It is submitted that petitioner is owner of the alleged truck and the truck was seized on 29.04.2022 and since then the alleged seized truck was kept in Ramana Maidan which is Malkhana of Sonepur Police Station. It is further submitted that the informant was deputed to look after the seized truck and he rented out the seized truck to some other person. When the
Patna High Court CR. MISC. No.15183 of 2023(2) dt.18-05-2023 2/2 petitioner saw that some one is driving the truck, he stopped the truck and the driver fled away, leaving the truck on road. The informant in order to save his skin filed the instant case against the driver and owner of the said truck. Petitioner is on bail in Sonepur PS Case No. 298 of 2022.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No. 318 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
