The petitioner, being the husband, has been in custody since 08.05.2017, seeks to renew his prayer for bail on the premise that he has already been in custody for over two years in connection with Suryapura P.S. Case No. 40 of 2017 registered for the offense punishable under Sections 304B,201/34 of the Indian Penal Code. Learned counsel for the petitioner submits that none of the prosecution witnesses at the trial have supported the case and, therefore, he may be extended the privilege of bail. A report had been called for from the Court of the 4th Additional District and Sessions Judge, Rohtas at Sasaram, which has been received from him by letter No. 27 dated

Patna High Court CR. MISC. No.15384 of 2019(3) dt.17-05-2019 2/2 02.04.2019 stating that out of the 10 chargesheeted witnesses, 4 have already been examined and the trial is well under way. Considering the aforementioned report and that the trial has advanced, let the trial Court take necessary steps to proceed in the same on day-to-day basis without giving any undue adjournment to either of the parties and conclude the same positively on or before the 31st of October, 2019. The prayer for bail stands rejected.
