JUSTICE SUDHIR SINGH ORAL ORDER 18-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 364, 120B and 34 of the Indian Penal Code.

Allegation against the petitioner is that he has kidnapped son of the informant/complainant and the victim is still traceless. It is submitted on behalf of the petitioner that he has got no criminal antecedent. The alleged occurrence is of the year 2009 and the case has been instituted in the year 2011. The delay has not been explained by the prosecution. It is further submitted that the independent witness in course of investigation has not supported the prosecution version. Other accused have been granted bail vide Cr. Misc. no. 36243 of 2014. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with

No.15775 of 2016 (2) dt.18-05-2016 2/2 two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Warsaliganj P.S. Case no. 26 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
