2. The petitioner seeks bail in connection with Nagar P.S. Case No. 224 of 2023, S.T. No. 53 of 2024 dated 28.06.2023 registered for the offences punishable under Sections 447, 448, 341, 323, 324, 307, 427, 354, 385, 379, 504, 506 read with Section 34 of the I.P.C.

3. As per the prosecution case, the informant does not have any child. A newly born boy was found lying on the road side in the village, he kept the boy with him whose name is Aman Kumar (petitioner) and now his age is about 19 years. The boy is addicted to drugs and has also doing illegal activities. The boy used to demand money and when the informant and his

2/4 wife denied to give him the said money, he assaulted the informant and his wife several times and injured them and for this, many cases have been lodged against him. It is further alleged that he was demanding Rs. 25,000/- from several days. When the informant denied to give him money, he assaulted the informant and his wife and threatened to kill and fled away. On 25.06.2023 at about 9.00 A.M., the accused came with a sharp dagger in his hand and started using abusive languages and struck the same on the neck of the informant with intention to kill but the same was struck on his head. He again struck the dagger upon the informant and again it was struck on his head. Due to which, his head got injured and blood started oozing out. Then he entered the house and started throwing out the household articles. He also took out Rs. 20,000/- from the box.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is adopted son of the informant and there is no any grievous injury caused to the informant and his wife. It is further submitted that the matter has already been compromised between the parties. The charge has been framed in the present case. It is further submitted that the doctor has examined the informant Surya Narayan Purve and his

3/4 wife Kaushaliya Devi and has found lacerated wound present on left frontal bone 2"x0.5"x0.25" on the body of the informant and simple injury caused by hard blunt object was found on Kaushaliya Devi. The petitioner has five criminal antecedents as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 28.06.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Madhubani in connection with Nagar P.S. Case No. 224 of 2023, S.T. No. 53 of 2024 with further conditions:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.

4/4 II. If the petitioner does any kind of illegal act with the informant and his wife or against his any family members, his bail bonds are liable to be cancelled.

7. The application stands allowed.
