This application for anticipatory bail, arises out of Khaira Police Station Case No. 409 of 2018, disclosing offences punishable under Sections 147, 148, 323, 427, 332, 333, 353 of the Indian Penal Code.
Learned counsel for the petitioners appears to be correct in his submission that no specific role has been assigned to any of the persons named in the First Information Report, who are said to have caused obstruction in due discharge of official duties by the police team. There are 18 persons named and 50 to 60 persons unknown, who are said to have committed the offence.
Considering the general and omnibus nature of allegation, this application is allowed.
Let the petitioners, above-named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of the learned C.J.M. Jamui in connection with Khaira Police Station Case No. 409 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
