Petitioner, already in custody, seeks bail in connection with Kotwali P.S. Case No.254 of 2015, registered under Sections 323/341/506/498A/34 of the Indian Penal Code. Allegation in brief is that the petitioner is habitual drunkard and used to assault his wife and children.

Learned counsel for the petitioner submits that earlier the petitioner was granted provisional bail with condition but in case of non-fulfillment of the condition the provisional bail was not confirmed. Now the petitioner is in custody since 02.12.2017. Petitioner is a government employee, there is no injury on the person of the informant and the informant too is a

Patna High Court Cr.Misc. No.4256 of 2018(2) dt.25-01-2018 2/2 working lady, however the petitioner is paying interim maintenance of Rs.5,000/- per month.

Having considered the said facts and circumstances, petitioner Bijay Kumar Gupta @ Vijay Kumar Gupta is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kotwali P.S.
