The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 403, 406, 408, 418, 120(B), 420, 425, 464, 468, 471 and 477A/34 of the Indian Penal Code.

Allegedly, it is a case of breach of trust developed between the parties in the matter of construction of flats/apartments, which were to be purchased by the informant

Patna High Court CR. MISC. No.14178 of 2022(3) dt.11-10-2022 2/3 thereafter. It is also alleged that the materials used in the construction work are of poor quality. Petitioners are director and builder of the project.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that other members who purchased the flats have not made any complaint against these petitioners and the said apartment is fully finished from inside as well as outside. He further submits that similarly situated co-accused has been granted anticipatory bail by this Court passed in Cr. Misc. No. 10030 of 2022. Petitioners have clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned P.K. Maliviya, Judicial Magistrate, Ist Class, Danapur/concerned Court in connection with Danapur P.S. Case No. 913 of 2019, subject to the conditions as laid down under Section 438(2) of
