The petitioner is languishing in custody since 7.9.2018 in a case registered for the offences punishable under Sections 302 and 201/34 of the I.P.C.

The prosecution case as per the Fardbeyan of Sadhu Sharan Singh recorded by SI Virendra Choudhary of Nawada Town Police Station on 22.1.2018, is to the effect that on the same day at 3.30 P.M., the informant while going to police station, found a gathering of large number of people and on enquiry came to know that a dead body packed in bag in pieces lying in the river bed, leading to registration of FIR against unknown. The name of the petitioner sprang up on the confessional statement of co-accused Saroj and Kundan.

It is submitted by learned counsel for the petitioner that

Learned APP submits that the name of the petitioner sprang up during investigation on the confession of co-accused. Considering the fact that the investigation has already been concluded, statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Nawada P.S. Case No.35 of 2018.
