JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 406, 420, 356, 311, 34 of the Indian Penal Code and 3 / 4 of Dowry Prohibition Act.

As per prosecution, the informant has arranged the marriage of his daughter with the petitioner and the date of marriage has been fixed. After engagement, the father of the petitioner demanded motorcycle and cash Rs. 30,000/- and when the informant did not become ready to fulfil the said demand, the father of the petitioner refused to marry his son. It has been submitted on behalf of the petitioner that the allegation of demand of dowry is not against the petitioner

Patna High Court Cr.Misc. No.32526 of 2017 (2) dt.13-07-2017 2/2 rather against the father of the petitioner and the father has been enlarged on bail by a co-ordiante bench of this Court vide order dated 11.07.2016 passed in Cr. Misc. No. 27543 of 2016. Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 10th Motihari in connection with Kotwa P.S.Case No. 102 of 2015.
