The petitioner seeks regular bail in connection with Tajpur P. S. Case No. 358 of 2017 registered for the offences punishable under Sections 25 (1-A), 25 (1-AAA), 25 ( 1-B) a, 251A, 26, 35 of the Arms Act and Sections 115, 120-B, 399 and 402 of the Indian Penal Code.
The allegation in brief is that all accused persons including this petitioner with illegal arms and ammunition were planning to commit murder of Md. Kaisar.
Learned counsel for the petitioner submits that this

No.5387 of 2018 (3) dt.23-02-2018 2/2 petitioner was neither apprehended at spot nor any incriminating material recovered from his possession while he was arrested from his house and he has been made accused only on the confessional statement of co-accused, Alok Kumar @ Ashutosh Kumar @ Manchun @ Ambani and the petitioner has involved in two cases and in both cases the petitioner are on bail. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named , be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Samastipur in connection with Tajpur P.S.Case No. 358 of 2017.
