JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-04-2022 The present petition has been filed for modifying the order dated 14.09.2020 passed in Cr. Misc. No. 17145 of 2020 to the effect that the time granted to the petitioner to surrender before the learned court below for availing the privilege of provisional bail be extended by a further period of four weeks from today.
The learned counsel for the petitioner has submitted that the petitioner had gone out side the State for earning his livelihood and on account of Covid-19 pandemic, he could not surrender before the Ld. court below in time, hence, a sympathetic view be
Patna High Court CR. MISC. No.15907 of 2022(2) dt.13-04-2022 2/2 taken and the time granted to the petitioner to surrender before the learned court below in order to avail the privilege of provisional bail be extended by a further period of four weeks.
Having regard to the facts and circumstances of the case and considering the submissions/ averments made in the present petition, I deem it fit and proper to grant further four weeks' time to the petitioner to surrender before the learned court of SubDivisional Judicial Magistrate, Araria in connection with Complaint Case No. 92C of 2018 for the purposes of availing the privilege of provisional bail. The order dated 14.09.2020 passed in Cr. Misc. No. 17145 of 2020 stands modified to the aforesaid extent. The rest of the order dated 14.09.2020 shall remain as such. The petition stands disposed of.
