The petitioner seeks bail in Bhawanipur (Balia O.P.) P.S. Case No. 89/2016, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 19.04.2017 passed in Cr. Misc. 8444/2017 along with 8467/2017 with observation that the petitioner may renew his prayer for bail after framing of charges as ordered in Cr. Misc. 2930/2017.

It is submitted that petitioners Bipin Singh and Babul Singh whose prayer for bail was earlier rejected vide order dated

Patna High Court Cr.Misc. No.31538 of 2017 (2) dt.19-07-2017 10.02.2017 passed in Cr. Misc. 2930/2017 have already been granted bail vide order dated 03.05.2017 passed in Cr. Misc. 21128/2017. Similarly situated another co-accused Mukesh Singh has already been granted bail vide order dated 28.06.2017 passed in Cr. Misc. 27137/2017. Charges have been framed against the petitioner also and the case of the petitioner stands on the same footing as that of other accused persons who have already been granted bail.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 2nd, Purnea in connection with Bhawanipur (Balia O.P.) P.S. Case No. 89/2016.
