JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-10-2024 Though the present writ petition has been filed for removing the encroachment made over the public land, which has resulted in obstruction of the ingress and egress to the agricultural land of the petitioner as also has led to blockage of the road connecting Darbhanga to the National Highway, i.e. N.H.-57, however, at the outset, the learned counsel for the respondent-State has submitted by referring to the counter affidavit filed in the present case that the Circle Officer, Singhwada has already passed the final order under Section 6(1)

Patna High Court CWJC No.7014 of 2020(3) dt.30-10-2024 2/2 of the Bihar Public Land Encroachment Act, 1956 on 12.11.2022, in connection with Encroachment Case No.14 of 2019, whereafter notices have also been issued to the encroachers, under Section 6(2) of the Bihar Public Land Encroachment Act, 1956, hence in case there is no other legal impediment and the encroachment has not already stood removed, the same shall definitely be removed, within a period of four weeks from today, by taking recourse to the due process of law. It is directed, accordingly.

2. The writ petition stands disposed off.
