The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273 of the I.P.C. and Section 30(A), 38(I) of the Bihar Prohibition and Excise Act, 2016.

As per allegation, 36 liters country made liquor have been recovered from tempo. Nothing has been recovered from the conscious possession of the petitioner. Petitioner claims his antecedent to be clean and he is in custody since 09.06.2017. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with

Patna High Court Cr.Misc. No.32374 of 2017 (2) dt.13-07-2017 2 / 2 two sureties of the like amount each to the satisfaction of A.D.J. II, Sitamarhi in connection with Parsauni P.S. Case No.16 of 2017.

Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.

However, before accepting the bail bond, the court below would make verification regarding criminal antecedent of the petitioner and if he is found to be involved in any criminal case prior to filing of affidavit in this application, i.e., 06.07.2017 then he would not be released.
