The petitioner seeks bail in connection with Chautham P.S. Case no. 181 of 2017 registered under Sections 420 of I.P.C. and Sections 30(g)(e)/36 of Bihar Prohibition & Excise Act-2016.
1279.2 lts. of beer is said to have been recovered from the warehouse of the Pancham Singh.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either with the seized liquor or with the place of recovery. He was not apprehended on the spot. He has been falsely implicated in the
Patna High Court Cr.Misc. No.23909 of 2018(2) dt.30-04-2018 2/2 case by the said Pancham Singh due to animosity. He has no criminal antecedent. He has been languishing in custody since 27.02.2018 and said Pancham Singh has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 12.03.2018 passed in Cr. Misc. no. 12670 of 2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-III-cum-Special Judge, Excise, Khagaria in connection with Chautham P.S. Case no. 181 of 2017. (Prakash Chandra Jaiswal, J) rohit/- U T
