JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-05-2022 Heard learned advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in anticipation of his arrest in connection with Janta Bazar P.S. Case No. 103 of 2020 dated 01.07.2020 instituted for the offences under Sections 341, 323, 504, 379, 354(B), 506 and 34 of the Indian Penal Code. The petitioner is the brother of the husband of the Informant who is alleged to have assaulted the Informant and also misbehaved with her mother-in-law.

The learned counsel for the petitioner submits that the accusation is highly motivated and for the purposes of putting pressure on the petitioner to part with the family property which is in his exclusive possession. The brother of the petitioner has prompted the aforesaid litigation through the mouth of his wife.

No.23926 of 2021(2) dt.24-05-2022 2/2 From the narration of events in the F.I.R., it would appear, it has been argued, that the occurrence has taken place within the four walls of the house and only for property dispute. Considering the aforenoted background facts and the relationship of the petitioner with the Informant and her husband, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Saran at Chapra in connection with Janta Bazar P.S. Case No. 103 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
