====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Motihari Town P. S. Case No. 650/2021 in a case registered for the offences punishable under Sections 304(B), 120B, 328/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

3. Allegation against petitioner is that he along with other F.I.R. named accused persons committed murder of the daughter of informant by administering poison, due to nonfulfillment of demand of dowry.

4. Learned counsel for the petitioner submits that petitioner is cousin brother of the husband of deceased and he

From perusal of the F.I.R., it is apparent that friendship between the deceased and her husband developed through matrimonial site and thereafter, love marriage was performed between them in Arya Samaj Temple, Ranchi and as such, there was no occasion for demand of dowry. Moreover, thrust of accusation is against husband of the deceased who has already been granted ad interim relief by order dated 14.02.2025. Petitioner is in custody since 22.12.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Town P. S. Case No. 650 of 2021.
